(hereinafter BOTECH), with TAX ID B86526480 and domiciled in Ronda de Valdecarrizo, 41-A, 1st floor, 28760, Tres Cantos, Madrid, in accordance with the current data protection regulations, REGULATION (EU) 2016/679 (General Data Protection Regulations, RGPD), wishes to inform the users and clients of ISOPH of the policy conducted concerning the treatment of all data, including those of a personal nature, that by the use of the functions of ISOPH will be made available to the company. 

This privacy policy describes how we use the information that you provide to us when you use ISOPH and the options you have regarding our use of the information. It also describes the measures we take to protect the information and how you can contact us to learn about our privacy practices. 

BOTECH reserves the right to modify this policy to adapt it to legislative or case law developments, as well as to industry practices. In such cases, BOTECH will announce on this page the changes made with reasonable advance notice of their implementation.

The processing of personal data is always carried out in a legal and fair manner.

You will always know what kind of information is provided to BOTECH before you start using the products and services. The data you provide depends on the services, products and features you use.

IN NO EVENT DOES BOTECH STORE OR MAKE INTRUSIVE USE OF DATA, BOTECH WILL ONLY PROCESS DATA, INCLUDING PERSONAL DATA, FOR CERTAIN PURPOSES THAT ARE LEGITIMATE WITH RESPECT TO THE APPLICABLE LAWS AND RELEVANT TO THE ACTIVITY OF ISOPH.

  • Guarantee the fulfillment of a contract with users and ensure the required performance of products and services for customers
  • Protect the user from known information security threats
  • Verify that the license is legal.
  • Update antivirus databases.
  • Increase the effectiveness of protection for devices, networks and information systems and, in particular, provide a faster response to new information and network security threats, increase the effectiveness of software protection component performance and decrease the likelihood of false positives
  • Improve user interaction and experience with our products and services, in particular by changing interfaces and providing desired content and advertising for commercial purposes.
  • Provide technical support for products and services to customers and improve the quality of products and services
  • Conduct statistical and other studies based on anonymous data

For the processing of our users’ data, we implement the appropriate technical and organisational security measures to comply with the confidentiality, integrity and availability required by the legislation in force.

 

Rights of the person concerned

 

Data subjects may have access to their personal data and may request that inaccurate data be corrected or, where appropriate, that they be deleted when, among other things, the data are no longer necessary for the purposes for which they were collected. In certain circumstances, data subjects may request that the processing of their data be limited, in which case we will only keep them for the exercise or defence of claims.

In certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data. BOTECH will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.

Data subjects shall also have the right to effective judicial protection and to lodge a complaint with the supervisory authority, in this case the Spanish Data Protection Agency, if they consider that the processing of personal data concerning them infringes the Regulation.

LEGAL BASES FOR DATA PROCESSING

The legal basis we apply depends on the purpose of the processing of personal data, which may be one of the following:

    • Contract: in accordance with Article 6 (1) (b) of the GDPR, in cases where we need to process certain data to make a contract, such as when a user accepts the EULA to use the software.

 

  • Consent: in accordance with Article 6 (1) (a) of the GDPR, the user declares to have been informed of the conditions regarding the protection of personal data, accepting and consenting to the processing of such data by BOTECH in the manner and for the purposes indicated in this privacy policy.

 

  • Legal obligation: in accordance with Article 6 (1) (c) of the GDPR, in cases where we have to process the data to meet legal requirements, e.g. for tax purposes.
  • Legitimate interest: in accordance with Article 6 (1) (f) of the GDPR, where we have legitimate interests as a cybersecurity company, unless these interests are subordinated to the interests or fundamental rights and freedoms of the user. In such cases, for example, where personal data are stored in our infrastructure and analyzed to detect recent and potential cyber-threats by means of artificial intelligence and/or by applying the expertise of our specialists, recital 49 of the GDPR recognises that it is a legitimate interest of an undertaking to process personal data to the extent necessary and in a proportionate way in order to ensure network and information security.

 

SECURITY OF THE INFORMATION HOW WE PROTECT YOUR PRIVACY

The security of the information is the main task of BOTECH. By default, all the data and information that you provide to us is confidential. BOTECH, therefore, always applies adequate and appropriate technical and organizational data security measures to protect personal data, considering the specific risks arising from the processing of personal data, as well as the most up-to-date security standards and procedures. 

Other key features of our information security program are:

  • Staff dedicated to Information Security who design, implement, and provide oversight for our information security program.
  • Application of the appropriate information security tools.
  • Evaluation of the performance of the security measures of the personal data applied before the start-up of the processing systems.
  • Implementation of controls to identify, authenticate, and authorize access to different services or websites.
  • Detection of the motives associated with the unauthorized access to personal data and the adoption of the corresponding measures.
  • Recovery of modified or destroyed personal data.
  • Encryption between our clients and servers (and between our various data centers).
  • We restrict access to personal information to our employees and contractors who need to know the information to process it for us and who are subject to strict contractual confidentiality obligations. In the event of failure to comply with these obligations, they may be subject to disciplinary action or termination of the contract.
  • Supervision of our systems infrastructure to detect weaknesses and potential intrusions.
  • Adoption of supervisory measures to ensure the security of personal data.
  • Provision to the BOTECH staff of relevant training and the continuous updating of our safety practices in the light of the new risks and the evolution of technology.

All the data that is collected and stored through the installation of the ISOPH product and service will be deleted as soon as the reason for such collection has been met. Therefore, the data will be saved until the ISOPH activity has been completed.

 

LIMITATION OR RESTRICTION OF THE DATA PROCESSING

 

IF YOU CHOOSE NOT TO PROVIDE THE DATA NECESSARY FOR THE OPERATION OF A PRODUCT OR FUNCTION, YOU MAY NOT BE ABLE TO USE THEM. THESE REQUIRED DATA ARE DETAILED IN THE END USER LICENSE AGREEMENT. IN ADDITION, WE ADVISE THAT YOU CAN REVERSE THIS DECISION AT ANY TIME.

 

What we are not going to process

Through its products and services, BOTECH never processes “sensitive” personal data such as religion, political opinions, sexual preference, health, biometrics, or other special categories of personal data. We do not want to receive this type of data, and we will not request it.

The ISOPH product must be installed and used by an adult. Children may use the device on which the ISOPH product is installed only with the permission of their parents or guardian. Except in the case of “data for the child protection function”, we do not intend to process or receive such personal information about children.
